In 2021, the Washington Supreme Court dismissed a state law that made drug possession a felony. The decision came after the law was deemed unconstitutional due to the fact that prosecutors were not required to prove that the offender knowingly had drugs. Because of this, Senate Bill 5536 was passed to ensure drug possession and public drug use wouldn't become fully decriminalized and instead become considered a misdemeanor under Washington law beginning July 1, 2023.
Senate Bill 5536 also went on to create a new pre-trial diversion program for drug offenders as a way of connecting them with addiction treatment services. Under this new ruling, a mandatory early conviction vacation can be issued if the drug offender complies with and properly completes a six-month drug recovery program request issued by the courts. This effort works to reduce the rate of reincarceration by addressing the concern of addiction rather than immediately moving forward with criminal convictions relating to drug offenses.
Local Initiatives to Help Curb Substance Abuse in Silverdale, WA
Back in 1990, the Kitsap County Board of Commissioners developed the Substance Abuse Prevention Program (KCSAAP) in an effort to develop substance abuse prevention resources for local residents in need. The program currently works to coordinate with existing prevention initiatives as well as family, youth, and school services to implement resources that help fight the deadly drug abuse concerns seen across the Silverdale and Kitsap County areas.
Over time, KCSAAP has gone on to develop more localized coalitions that work to target drug abuse concerns across different areas of the county. These groups also hold monthly meetings to discuss their ongoing efforts to identify future areas of program improvement and enhancement.
