Specimens we can test for DNA

The easiest and most reliable way to obtain a DNA sample for paternity testing is to swab the inner cheeks of the alleged father and child or children. These skin cells are known as buccal cells, and they rub off easily onto cotton swabs and remain in place for analysis by our laboratory.

Other specimen samples, such as hair follicles, fingernails, and garments that might contain someone’s DNA, can also be tested. An Alternative Specimen DNA Test is done by ordering one of our testing kits online and shipping the specimens back to us.

Legal DNA Tests vs. “Peace of Mind” At-Home Tests

A Legal Paternity Test is a court admissible lab testing service performed at an AABB accredited laboratory. Accurate results for DNA paternity testing with 99.99% confidence or greater take about a week.

When deciding which type of DNA test is right for you, consider first what you might do with the results. A legal paternity DNA test will hold up in court for such matters as child support or to change the name on a birth certificate. This test must be performed using strict chain of custody procedures. Our Newton DNA testing technicians are trained to follow these guidelines so that the results will be legally admissible.

How to Establish Paternity in Newton

In Newton, and the rest of Massachusetts, when a child is born to unmarried parents, he or she has no legal father until steps are taken to establish paternity. The easiest way to do this is for both parents to sign and file a Voluntary Acknowledgement of Paternity form. Once this is filed, the man’s name is added to the child’s birth certificate and he is deemed the child’s legal father.

If both parents don’t agree about the child’s paternity, then one party will need to start a court action. In this case, a judge will often require a DNA paternity test before ruling on the case.

Benefits of Establishing Paternity

According to Newton’s Infinity Law Group, there are many benefits of establishing legal paternity. Doing so will allow the child to access the father’s medical history and will give him or her the right to receive financial support, receive an inheritance, and share in the father’s benefits including Social Security, health insurance, and pension benefits.

It’s also important to note that until paternity is established courts also cannot rule on important decisions like child support, visitation, and child custody.

Paternity and Child Support

The ability to receive child support is one of the primary reasons mothers seek to establish paternity. Attorneys at the Newton-based Halks Firm advises men not to start paying child support until they have established legal paternity. Once an alleged parent agrees to child support payments, it’s nearly impossible to have this reversed. This is true even if DNA tests later prove the man is not the child’s biological father.

If a mother asks you to start paying child support and you’re not completely sure you’re the child’s father, it’s always advisable to take a legal DNA test before making any decisions. Since these cases can become complex, it’s also a good idea to consult with an attorney.
