New CA Civil Service Rule Protects Marijuana Users

The California State Personnel Board recently set precedent by ruling that testing positive for prior marijuana use doesn't accurately show whether an employee was impaired at work. They further stated that since a positive marijuana urine test is only an indication of past use, it is not grounds for discipline. While this doesn't apply to some positions, such as policing, most state workers will now have less fear of repercussion following a positive test.

According to Santa Cruz County Coroner's Office data released in May of 2021, drug overdose deaths associated with fentanyl use in the county nearly quadrupled from 5 in 2019 to 19 in 2020. This powerful synthetic opioid has been found in an array of other drugs including heroin, cocaine, Xanax, methamphetamine, and even cannabis. This trend has officials concerned.

Denise Elerick, who founded The Harm Reduction Coalition of Santa Cruz County, recommends using fentanyl test strips to avoid overdoses. However, she notes that these strips cannot tell you the actual amount of fentanyl present, so it's not a foolproof prevention method. According to Elerick, Santa Cruz County has also had one of the highest overdose rates in the entire state for several years.
