Specimens we can test for DNA

The easiest and most reliable way to obtain a DNA sample for paternity testing is to swab the inner cheeks of the alleged father and child or children. These skin cells are known as buccal cells, and they rub off easily onto cotton swabs and remain in place for analysis by our laboratory.

Other specimen samples, such as hair follicles, fingernails, and garments that might contain someone’s DNA, can also be tested. An Alternative Specimen DNA Test is done by ordering one of our testing kits online and shipping the specimens back to us.

Legal DNA Tests vs. “Peace of Mind” At-Home Tests

A Legal Paternity Test is a court admissible lab testing service performed at an AABB accredited laboratory. Accurate results for DNA paternity testing with 99.99% confidence or greater take about a week.

When deciding which type of DNA test is right for you, consider first what you might do with the results. A legal paternity DNA test will hold up in court for such matters as child support or to change the name on a birth certificate. This test must be performed using strict chain of custody procedures. Our Saint Cloud DNA testing technicians are trained to follow these guidelines so that the results will be legally admissible.

DNA Paternity Testing in the City of Saint Cloud, MN

Minnesota’s Presumption of Paternity

In the state of Minnesota, there are some circumstances that lead to a “presumption of paternity.” According to St. Cloud attorneys Moss & Barnett, paternity presumptions are generally marital, biological, or intent-based. A marital presumption occurs when a child is born to married parents. In this case, the mother’s husband is presumed to be the child’s legal father, whether he is the biological father or not.

Biological presumption occurs with DNA testing that proves a man is a child’s biological father. Intent-based presumption occurs when a man “openly holds out a child as his own” during the first two years of the child’s life.

Each of these presumptions can become complicated and may be skewed by individual circumstances. This is one reason why it’s so important to seek legal counsel when dealing with any type of paternity issue.

Establishing Paternity in St. Cloud

When a child is born to unmarried parents in the state of Minnesota, steps must be taken to establish legal paternity. Until this happens, the child’s biological mother has “sole legal and physical” custody of the child. According to St. Cloud attorney group Pennington, Cherne, Gaarder & Geiger Hagen, there are two primary ways to establish legal paternity.

First, if both parents agree about the identity of the child’s biological father they can sign and file a Voluntary Recognition of Parentage form. Otherwise, one party will need to petition the courts to enter an order establishing legal paternity. If there is a dispute about the child’s paternity, the courts will likely order both the mother and alleged father to take a DNA paternity test.

Paternity and Child Support

A mother cannot request child support until legal paternity has been established. Once she receives a court ruling of paternity, the courts can also order the child’s father to provide basic, medical, and childcare support. The Stearns County Human Services Department assists parents with locating missing parents, enforcing support orders, and more. Area residents can visit the department at 705 Courthouse Sq, Fl 2, St. Cloud, MN, 56303-4781 or contact them at (320) 656-6000.
