The easiest and most reliable way to obtain a DNA sample for paternity testing is to swab the inner cheeks of the alleged father and child or children. These skin cells are known as buccal cells, and they rub off easily onto cotton swabs and remain in place for analysis by our laboratory.

Other specimen samples, such as hair follicles, fingernails, and garments that might contain someone's DNA, can also be tested. An Alternative Specimen DNA Test is done by ordering one of our testing kits online and shipping the specimens back to us.

New Florida Law Protects Fathers' Paternity Rights

In 2018, the Florida Supreme Court ruled against a decades-old law that prevented biological fathers from being automatically blocked from having contact with children who are born to mothers who are married to someone else. While cases like this happen all across the state of Florida, it hit home when Loxahatchee resident Christopher Farrell found himself in this exact situation.

Farrell, who was ecstatic to celebrate the birth of his child, ended up being blocked from having any contact with him because the mother of his child married another man before the child was born. Prior to this ruling, the law stated that a woman's husband was unequivocally declared a child's legal father. Now, a child's biological father will have the opportunity to argue in court that having contact with the child is in the child's best interests. This opens up an opportunity for him to be involved in the child's life.

Establishing Paternity in Palm Beach County

According to Alan R. Burton, a family law attorney serving Palm Beach County and the surrounding area, unmarried parents must take steps to establish a child's legal paternity. Otherwise, the state of Florida will not recognize a man as the child's father. There are two primary ways to do this. The first is for both parents to sign and file a Voluntary Acknowledgement of Paternity. The second is through a court order. Either the child's mother or alleged father can file a case in court. Before making a ruling, the courts will order a DNA paternity test to confirm the child's biological parentage.

Paternity Disestablishment in Florida

Unlike some other states, Florida has a procedure for disestablishing paternity. According to Palm Beach attorneys at The Law Offices of Jessica Mishali, P.A., only the man can initiate a case to disestablish paternity. The statute outlines very specific information the man would need to provide and showing fraud or duress is not a requirement. The child must be under 18 when the petition is filed, and the man must be up-to-date on all child support payments. If paternity is disestablished, the law also does not allow the man to recover child support that was previously paid.
