There are also numerous post-employment instances when a place of work orders drug screening in Flagstaff. Reasons may include random drug screenings of safety-sensitive employees, post-work accident testing, reasonable suspicion testing, or even post-treatment testing of employees who were recently injured and prescribed narcotics.

Court Mandates

For the Flagstaff legal scene, drug testing is also frequently used in Coconino County Court, where local judges mandate routine screenings for criminal offenders. Pre-Employment Testing Law & Regulations

In the state of Arizona, there are no laws preventing Flagstaff employers from conducting pre-employment drug testing. However, under Arizona Statute 23-493.04, the terms by which employers conduct pre-employment drug screenings must be described in a written policy that is distributed prior to screening. Flagstaff employers should also refer to the Americans with Disabilities Act (ADA) in the event an employee is disabled and legally prescribed certain medications.

Workplace Accident Testing & Regulations

The U.S. Bureau of Labor Statistics reported 57,100 nonfatal workplace injuries across Arizona in 2021 alone. Under Arizona Statute 23-493.04, an employer is allowed to conduct a workplace accident drug test on both the injured employee and any employees who are believed to have contributed to the accident, which must be completed as soon as possible after the incident.

Can Employers Test for Marijuana Even Though It's Legal in Arizona?

While there are no laws preventing employers from using Flagstaff marijuana testing, Section 36-2813 of the Arizona Medical Marijuana Act prohibits employers from discriminating against a person in hiring or job termination if they are a registered medical marijuana patient. In the event of suspected on-the-job marijuana use, Arizona marijuana laws allow Flagstaff employers to take adverse action through reasonable suspicion drug testing.
