Ban the Box

Arizona is one of 35 U.S. states to pass “ban the box” laws. The purpose of this law is to give applicants with a criminal history a fair chance of gaining employment. It prohibits employers from asking about a job applicant’s criminal history on an application or at any point prior to the initial interview. If there is no initial interview, then employers may not ask about an applicant’s criminal history until after a conditional offer for employment has been made.

It should be noted, however, that in the state of Arizona this law only applies to businesses with more than 15 employees.

Arizona Civil Rights Act

In addition to Federal protections offered by the Fair Credit Reporting Act (FCRA) and the Equal Employment Opportunity Commission (EEOC), job applicants in Arizona are also protected by the Arizona Civil Rights Act. This provides additional guidelines intended to prevent discrimination during the hiring process.

Employers are not prohibited from asking about an applicant’s criminal history or running a background check that includes this information, as long as they follow all guidelines. They’re also allowed to request detailed information, including when and where the crimes took place and the final disposition.

The inquiry must meet the “ban the box” rules listed above and comply with all Federal guidelines, including providing stand-alone disclosures and obtaining the applicant’s written permission prior to running the background check. In addition, the employer must make it clear that information about a criminal conviction won’t automatically result in the denial of their employment.
