The city of Albuquerque, NM does not have city-specific background check laws. However, the city is required to abide by state and federal laws.

As of April 2019, New Mexico adopted two new laws regarding background checks. New Mexico became a "ban the box" state. The law prohibits employers with at least four employees from asking about criminal histories on employment applications. Employers may only discuss criminal background information after the application has been reviewed and employment has been discussed with the applicant. Employers in New Mexico are not prohibited from informing the applicant that their employment policy may disqualify them from positions if they have certain criminal convictions.

New Mexico also passed a Criminal Record Expungement Act, allowing residents with certain arrests and convictions to petition the court for expungement. This law took effect in 2020 and allows the applicant to not disclose the information to the employer.
