Specimens we can test for DNA

The easiest and most reliable way to obtain a DNA sample for paternity testing is to swab the inner cheeks of the alleged father and child or children. These skin cells are known as buccal cells, and they rub off easily onto cotton swabs and remain in place for analysis by our laboratory.

Other specimen samples, such as hair follicles, fingernails, and garments that might contain someone's DNA, can also be tested. An Alternative Specimen DNA Test is done by ordering one of our testing kits online and shipping the specimens back to us.

Legal DNA Tests vs. "Peace of Mind" At-Home Tests

A Legal Paternity Test is a court admissible lab testing service performed at an AABB accredited laboratory. Accurate results for DNA paternity testing with 99.99% confidence or greater take about a week.

When deciding which type of DNA test is right for you, consider first what you might do with the results. A legal paternity DNA test will hold up in court for such matters as child support or to change the name on a birth certificate. This test must be performed using strict chain of custody procedures. Our McDonough DNA testing technicians are trained to follow these guidelines so that the results will be legally admissible.

Georgia Law: Paternity vs. Legitimization

In many states, when a child is born to unmarried parents, establishing legal paternity provides both the mother and the father with important legal rights. However, in Georgia, there is a difference between paternity and legitimization. According to experts at the E.N. Banks-Ware law firm, which serves clients in McDonough and the surrounding area, paternity confirms the identity of a child's legal father, while legitimization legally establishes a relationship between a child and his or her father.

Until legitimization has been established, an unmarried father does not have rights to visitation or child custody. Since only a child's biological father can file for legitimization, legal paternity must be established first.

Filing a Paternity Acknowledgment in McDonough

In Georgia, a child's legal paternity can be established voluntarily by signing and filing a Paternity Acknowledgment (PA) form. According to the Henry County Probate Court, located in McDonough, this form cannot be used if the child's mother was married to anyone in the 10 months before the child was born or if another man is listed on the child's birth certificate.

Either parent can rescind a PA form within 60 days of signing. After that time period, the form can only be challenged in a court of law, and only for specific reasons such as duress, fraud, or material mistake of fact.

Benefits of Establishing Paternity in Georgia

Attorneys at the McDonough-based South Atlanta Family Law Firm explain that there are many benefits that come with establishing a child's legal paternity. Once this is done, the father's name can be added to the child's birth certificate and the child may be able to receive financial support, Social Security, and veterans' benefits from the father. Establishing legal paternity is also a necessary first step for fathers who want to have a relationship with their child.
