According to Conyers family law firm M. Qader A. Baig & Associates, LLC, in the state of Georgia an "order of legitimation"must be obtained before an unmarried man is presumed to be the father of a child. Contrary to popular belief, adding a man's name to a child's birth certificate does not legally establish paternity. Unmarried parents who wish to resolve child support, custody, and visitation rights must first go through a legal process.

When both parents agree to the paternity of the child, the process of obtaining an order of legitimation is simple. However, if either party challenges the paternity, then a DNA paternity test will be required. In cases where a man and woman are married at the time of a child's birth, the man is assumed to be the child's legal father.

Challenging Paternity During Marriage

Meriwether & Tharp, a divorce team serving Conyers and surrounding areas, states that although paternity testing during divorce proceedings isn't common, sometimes the issue does arise. One such incident occurred when the Georgia Court of Appeals ruled on the 2010 case Williamson v. Williamson.

In this case, a woman who was divorcing her husband requested a paternity test, alleging that the husband was not the biological father of their child. The husband opposed the request. The courts ruled in his favor, stating that the paternity test was not "in the child's best interest."

The appeals court upheld this, based on the Georgia law stating that all children born during a marriage are deemed to be legitimate. The court went on to say: "[t]he public policy favoring the presumption of a child's legitimacy is one of the most firmly-established and persuasive precepts known in law." To this date, if a mother in Georgia wants to challenge her husband's paternity (delegitimizing the child) and the father objects, she must first show that doing so is in the best interests of the child. Otherwise, the request will be denied.
