Specimens we can test for DNA

The easiest and most reliable way to obtain a DNA sample for paternity testing is to swab the inner cheeks of the alleged father and child or children. These skin cells are known as buccal cells, and they rub off easily onto cotton swabs and remain in place for analysis by our laboratory.

Other specimen samples, such as hair follicles, fingernails, and garments that might contain someone's DNA, can also be tested. An Alternative Specimen DNA Test is done by ordering one of our testing kits online and shipping the specimens back to us.

In the state of Massachusetts, there are several circumstances when a man is automatically presumed to be a child's legal father. According to experts at the Framingham-based Tsizer Law, a presumption of paternity occurs when:

A child's mother was widowed or divorced in the 300 days prior to the child's birth. In this case, the mother's husband or ex-husband is presumed to be the child's father unless the mother has signed paperwork stating otherwise.

The man acknowledges paternity, and the mother does not object within a set amount of time.

How to Establish Legal Paternity in Massachusetts

When a mother is not married at the time of the child's birth and a presumption of paternity does not exist, steps must be taken to establish a child's legal paternity. Framingham-based Barach Law Group explains that there are several ways to do this. A Voluntary Acknowledgment of Parentage form can be used when both the mother and the father agree that the man is the child's biological father. Once this form is signed and filed, the man becomes the child's legal father, and his name is added to the birth certificate.

If the parents do not agree about the identity of the child's biological father, a court order may be needed. In this case, an interested party can file a Complaint to Establish Paternity. The judge will typically order a DNA test before issuing a ruling. If genetic testing determines that the man is the child's biological father, his name is added to the birth certificate, and he is responsible for paying child support.
