In May 2023, Iowa Governor Kim Reynolds signed a new bill into law that increases the criminal penalties for selling fentanyl as well as the sale of any illegal drug that results in death or serious injury. The passing of HF 595 comes at a time when the state of Iowa has experienced a 45% increase in the number of opioid overdose deaths between 2019 and 2022 alone.
Under this new law, the sale and manufacturing of fewer than five grams of fentanyl is now considered a Class C felony, which holds a punishment of up to 10 years in prison and up to a $50,000 fine. Enhanced sentencing updates under this new law have now tripled for individuals found delivering or manufacturing fentanyl that resulted in the death of another person. The new bill went into effect on July 1, 2023.
