Mobile Occupational Health Laws, Acts, and Legislation

Alabama Code Section 480-3-3-.34 requires a "careful and thorough" physical examination by a licensed physician prior to being hired for employment in the mining industry. This exam must include an assessment of the job candidate's vision, hearing, the condition of his or her heart and lungs, and any mental or physical defects or abnormalities that may impact his or her health or the safety or health of fellow employees.
Alabama Code Title 34 § 34-21-93.1 states that when laws or rules require certain forms to be signed, certified, or otherwise verified by a physician, it must also accept a signature, certification, or verification from a certified nurse practitioner or certified nurse midwife. This includes forms related to employment physicals for bus drivers and employment and pre-employment physicals for Transportation Security Agency (TSA) employees.
AL Admin. Code R 610-X-7-.07 allows registered nurses and certified registered nurse practitioners to administer OSHA's Respiratory Standard Medical questionnaire, refer employees for further evaluation based on their responses to the questionnaire, and perform medical examinations related to the questionnaire, if appropriate for their area of practice.
AL Code § 16-22-3 (2021) prohibits school authorities from hiring teachers, bus drivers, food handlers, or janitors who have tuberculosis at an infectious stage.
Ala. Admin. Code r. 420-5-7-.06 requires hospitals in the state to establish employee vaccination requirements that are consistent with current recommendations of the Federal Occupational Safety and Health Administration (OSHA) and Federal Centers for Disease Control and Prevention (CDC). This includes, at minimum, an annual influenza vaccine.

Local Information for Mobile Occupational Health Testing

Unlike some other states, which have their own Occupational Safety and Health Administrations, Alabama falls under the jurisdiction of the federal OSHA, which is tasked with ensuring safe and healthy working conditions for U.S. workers by setting and enforcing workplace standards and providing education, training, outreach, and assistance to workers and employers. There are two federal OSHA offices in Alabama, one in Birmingham, and one in Mobile.

In addition to OSHA rules, workers in Mobile, Alabama, and the rest of the state are protected by federal, state, and local laws, such as Alabama Code Section 480-3-3-34, which was enacted in 1975 to protect mine workers, and Ala. Admin. Code r. 610-X-7-.07, which began allowing OSHA Respiratory Standard Medical questionnaires to be completed with registered nurses and certified nurse practitioners beginning in 2016.
