In the state of California, there are three primary ways to establish a child's legal paternity. According to the Whittier-based ABA Family Law Firm, the parent's relationship at the time of the conception is a primary factor in the process. If the parents are married and "cohabitating" at the time, the mother's husband is presumed to be the child's legal father. This presumption of paternity can be rebutted with a court-ordered DNA test; however, the test must be requested within the first two years of the child's life.

Unmarried parents can either complete a voluntary acknowledgment of paternity or petition the courts to establish legal paternity. The courts will typically order a DNA paternity test prior to issuing a ruling.

California's Parentage Opportunity Program

A child's legal paternity, also known as "parentage" can be easily established through the state's Parentage Opportunity Program (POP). This allows eligible parents to complete and file a form, which has the same effect and force as a judgment for parentage that has been issued by the courts. To be eligible, unmarried parents must feel confident that the man is the child's only possible biological father. If there is any question regarding the identity of the child's father, the POP program does not apply, and a court-ordered DNA test is needed.

The voluntary acknowledgment of paternity form can be completed at the hospital when the child is born, at the local child support agency office, at offices of local registrars of births and deaths (vital records), or at county welfare departments.
