How to Establish Paternity in Oklahoma

In Oklahoma, when a married couple has a child, the mother's husband is presumed to be the child's legal father. This is also true if the parents were married within 300 days prior to the child's birth. However, when a child is born to unmarried parents, steps must be taken to establish paternal rights.

Edmond-area attorney L. Todd Nalagan explains that this can be done by completing and filing a voluntary acknowledgment of paternity form when both parents agree to sign. If there is a question about whether a man is the child's biological father, paternity can be established by the courts. In this case, the judge will typically order genetic testing before issuing a final paternity order.

The Link Between Legal Paternity and Father's Rights

According to the Edmond-based law firm of Tamra A. Spradlin, when an unmarried couple has a child, the mother is automatically given sole custody. The child's father has no legal rights until he has established legal paternity. This is true even if the father's name is on the child's birth certificate.

It's also important to note that while the Oklahoma DHS Child Support Services can establish paternity through a DNA test to establish a child support order, this also does not give the father visitation or custody rights. The man will still have to petition the courts to set up a visitation schedule and a custody order.

Denying the Presumption of Paternity

When a married woman has a child, the state of Oklahoma presumes that the husband is the child's father. However, there are some cases when the husband may not be the child's biological father. When this happens, either the child's mother or her husband can sign and file a Husband's Denial of Paternity form within two years of the child's birth. This can help ensure that a man is not held financially responsible for a child that is not his. It's also a required step if another man wants to establish his legal paternity.
