Avuncular DNA Test (aunt/uncle and niece/nephew)

Specimens we can test for DNA

The easiest and most reliable way to obtain a DNA sample for paternity testing is to swab the inner cheeks of the people being tested. These skin cells are known as buccal cells, and they rub off easily onto cotton swabs and remain in place for analysis by our laboratory. Other specimen samples, such as hair follicles, fingernails, and garments that might contain someone's DNA, can also be tested. An Alternative Specimen DNA Test is done by registering online and shipping the specimens to us.

Legally Admissible DNA Tests vs. "Peace of Mind" At-Home Tests

A Legal Paternity Test is a court admissible DNA testing service. Accurate results for DNA paternity testing with 99.99% confidence or greater take about a week.

When deciding which type of DNA test is right for you, consider first what you might do with the results. In order for the results of a DNA test to hold up in court, for child support, or to change the name on a birth certificate, the test must be done at a clinic using strict chain of custody procedures. Our Bohemia DNA testing technicians are trained to follow guidelines that ensure that the results can be used for legal purposes.

Establishing Paternity in Bohemia NY

In New York state, if a child is born to unmarried parents, it's necessary to take steps to establish legal paternity. There are two primary ways to do this:

1. Both parents can sign and file a voluntary Acknowledgment of Parentage (AOP) form

2. File a petition with the Family Court.

Once a man has been declared the legal parent of a child, he is responsible for the child's financial care and medical support. In addition, he has full parental rights and can request visitation with the child and/or custody.

Canceling an Acknowledgment of Paternity

If either parent changes their mind after signing a voluntary acknowledgment of paternity (AOP), they can request a court trial to reverse it. This must be done within 60 days, otherwise, the parent will have to show proof of "fraud, duress, or material mistake of fact."

Once the case goes to court, the Support Magistrate will decide whether the acknowledgment should be reversed, based on the facts presented and the best interest of the child. It's often possible for someone who is not a child's biological father to still be deemed the legal father and still continue to have to pay child support. This is one reason why it's critical to be completely sure about your paternity before signing the AOP form.

Understanding Paternity Trials in NY State

According to information provided by the Suffolk County government, if a paternity case goes to trial, both parents have the right to a lawyer, and the alleged father also has the right to ask for genetic marker tests.

It's important to note that any man who receives notice to appear in court must appear, even if you believe the child is not yours. If you do not go to court, the judge can declare you the child's father in what's called a "default judgment."
