Under Georgia law, when a married couple has a child, no steps are necessary to establish legal paternity as it is presumed that the husband is the child's biological father. For an unmarried father to have his name placed on the child's birth certificate and to gain potential custody and visitation rights, he will need to properly establish legal paternity. As long as both parent parties are in agreement, the simplest way to establish paternity in Georgia is by completing an Acknowledgment of Paternity.

The form is completed by both parents and legally identifies the presumed father to be the child's biological father. In instances where a mother or father does not agree to establish paternity, a paternity petition will need to be filed through Sumter County Family Court. A court-ordered process will typically require the mother, presumed father, and child to undergo DNA testing to effectively prove legal paternity.

Disestablishing Paternity in Americus, GA

When two Americus parents are quick to act upon a paternity presumption, the man who was believed to be the child's father may learn that he is not the biological father. For individuals who learn that the paternity presumption was incorrect after already establishing paternity, there are two ways of going about paternity disestablishment.

If it has been less than 60 days from the legal establishment of paternity, a parent can rescind this acknowledgment and have the father's name removed from the birth certificate or have changes made to the child's surname.
