Protecting Employees and Customers with Background Checks in Ohio

There are many industries in Ohio that mandate background checks as an integral part of the hiring process. Typically, state law requires hiring managers to conduct background checks on employees who are working with vulnerable populations, like children or the elderly. Other public and private companies may choose to ask applicants to complete a background check as part of their hiring process — the choice is theirs to make. All of these background checks are processed through the Bureau of Criminal Investigation run by Ohio's Attorney General.

In Ohio, the state government has implemented ban-the-box policies for all public sector employees statewide. There are also some municipal governments that have decided to take it a step further, and pass legislation prohibiting both public and private employers within their jurisdiction from asking about past criminal convictions on job applicants. Any industry or municipality that is covered by ban-the-box policies can only request a background check from applicants once a conditional offer of employment has been extended.

In 2016, the Ohio Fair Hiring Act was implemented, which prohibits felony convictions from being used against some public employees, unless the conviction took place while the person was employed as a public employee. This helps give non-violent convicted felons a fair chance at a new job, which can be a stepping stone to a better life.
