Ontario Occupational Health Laws, Acts, and Legislation

According to the Cal/OSHA Industry Safety Regulation §5194 Hazard Communication regulation, employers that require employees to work around hazardous materials must create a hazard communication plan. This plan will be used to identify the location, risks, and handling procedures for each hazardous material as well as the response methods that are to be used in the event of exposure. Response tactics may sometimes include the use of workplace occupational health testing to ensure employee well-being.
Under California Education Code Section 49406, all California school district employees and contracted employees will be required to undergo a tuberculosis risk assessment as part of the pre-employment health screening process. In the event that any risks are identified, the employee will then be required to undergo tuberculosis screening and a respiratory health exam to ensure there is no risk of infection.
California Health & Safety Code §1288.7 requires vaccination against influenza annually for all general acute care hospital employees. General acute care hospital employers will also be required to provide these vaccination services free of charge and properly document an instance where an employee declines annual influenza vaccination services.
Under the Federal Motor Carrier Safety Regulations (FMCSR) medical exam mandate, a pre-employment health exam consisting of a hearing and vision screening, employee physical, and employee drug test must be completed by Ontario transportation employees who must obtain a commercial driver's license (CDL) for work purposes.
