Overall Status: Partially legal

According to the latest law signed on the second of February 2022, the use of medical marijuana is now permitted in Mississippi. With this Act, Mississippi became the 37th state to allow medical cannabis use.

Medical Marijuana: Legal

In the past, the only allowance for patients with debilitating epilepsy was to consume CBD oil that contains 0.5% or less THC and at least 15% CBD. This CBD oil may only be obtained from the University of Mississippi Medical Center's Department of Pharmacy Services. But since February 2022, the medical use of marijuana has been legal. The Mississippi Medical Cannabis Act, sponsored by Senator Kevin Blackwell, will create a medical cannabis program for Mississippians.

Decriminalized: Yes

While marijuana use is illegal in Mississippi, it is also decriminalized. The first offense for possession of up to one ounce of marijuana or 10 grams of synthetic cannabinoids is punishable by a fine of $100 to $250. Subsequent offenses are punishable by higher penalties. First-time offenders will receive a civil summons rather than arrest, and there is no jail time associated with this offense.

A second and third offense are both misdemeanors. The second offense carries a mandatory minimum of five days in jail, with a maximum of 60 days, and a maximum fine of $250. A third offense has a mandatory minimum of five days in jail with a maximum of six months, as well as a maximum fine of $1,000.

Recreational Marijuana: Illegal

There are no recreational marijuana laws in the state of Mississippi. Offenders who are caught possessing or consuming marijuana will be subject to penalties.
