Specimens we can test for DNA

The easiest and most reliable way to obtain a DNA sample for paternity testing is to swab the inner cheeks of the people being tested. These skin cells are known as buccal cells, and they rub off easily onto cotton swabs and remain in place for analysis by our laboratory. Other specimen samples, such as hair follicles, fingernails, and garments that might contain someone’s DNA, can also be tested. An Alternative Specimen DNA Test is done by registering online and shipping the specimens to us.

Paternity Opportunity Program

In an effort to create a link between children and their alleged fathers, the California Department of Child Support Services has developed a program with licensed clinics and hospitals to called the Paternity Opportunity Program.This program, with the cooperation with the mother and alleged father, establishes paternity even if the parents are not married, prior to the birth of the child. If paternity is in question, a prenatal DNA test is a court admissible paternity test that can be done during pregnancy.

By establishing who the father is prior to brith, it allows the child to have the same benefits as a child with married parents. When a child is born to a married mother, her husband is presumed to be the father, and both parents are put on the birth certificate, which confers several advantages. Some of these advantages include having both parents permitted to make medical decisions for the child, obtaining medical insurance from either parent, and inheritance rights.

Petitioning for Child Custody

In San Diego, like California in general, unmarried parents seeking full custody of a child must file for it through the Family Court, which may or may not approve it. Part of this process may include a requirement to get a court admissible paternity test. This filing process is known as a petition for child custody. The time it takes to fulfill this request heavily relies upon whether or not the parents cooperate with each other. The allotted time is known as the mediation period. The mediation period is one factor that the courts use as an indicator on which parent will obtain custody.

When making a custody determination, the court will always try to maintain as much “normalcy” as possible in the child’s life. If this period goes smoothly, it can be a prime factor influencing the judge to decide upon joint custody. When join custody is granted, the kids split time between the parental homes, and the parents are expected to work together in making legal decisions for the children.
