In Idaho Falls, ID, if a child is born to two married parents, it is generally legally declared that the husband is the father of the child. When parents of a child are not married at the time of birth, the state of Idaho requires both parents to legally establish paternity themselves. To do so, both parents will need to agree to and sign an Acknowledgment of Paternity at the hospital following the child’s birth or through a Bonneville County Child Support Services office.

In the event that either parent does not agree to sign the acknowledgment, paternity will then need to be established by filing a paternity action through the Idaho Family Court system. To be seen in court, either mother or father will be required to file a Petition for Paternity and have it served to the opposing parental party. From here, a judge will order DNA testing to correctly establish paternity and further mandate any necessary child support services.
