Presumption of Paternity in Puerto Rico

According to Puerto Rico law, if a child is born to parents who are married, it is presumed that the mother's husband is the child's legal father. The law also presumes paternity if a child is born within 300 days after a marriage is terminated. If a father voluntarily acknowledges a child as his own, this also creates a presumption of paternity.

In cases where the presumption of paternity is not correct, an interested party should challenge the presumption within six months of becoming aware of the inaccuracy or from the date of approval of the presumption (whichever is later). If a DNA test shows that the man is not the child's biological father but he acknowledges the child anyway, the parents won't have grounds to later dispute the presumption of paternity.

Rights of Legitimate Children

In Gurabo, and all other parts of Puerto Rico, once paternity is established, the child is considered "legitimate." According to PR law, a legitimate child has certain rights, including:

1. Using the family name of his or her father or mother

2. Receiving financial support from both parents

3. Receiving an inheritance from both parents
