Background Check Laws Specific to the State of Alaska

Although it’s separated from the contiguous United States by Canada, Alaska is still governed by the same federal laws and legislation as the other 49 states. This includes all policies related to hiring and the background checks that employers can use to keep their company and its stakeholders safe.

All background checks in Alaska are governed by the Fair Credit Reporting Act (FCRA), which requires that all employers who are conducting a background check on a current or future employee to get their consent in writing. The FCRA also specifies that information related to criminal activity on the background check may not go back further than 7 years.

In Alaska, the legislation AK Stat § 12.62.160 (2014) further specifies that all criminal justice background check information “may be provided to a person for any purpose, except that information may not be released if the information is nonconviction information or correctional treatment information.” This should be enough information for hiring managers to see whether a crime was committed and if it has any effect on the potential hire’s suitability for the job in question.

No ban-the-box legislation has been passed in Alaska as of 2020, so employers may choose to ask questions about the applicant’s criminal history at any point in the hiring process. As long as they follow the above statute, as well as the FCRA, they can choose to ask questions about criminal history as early as the initial application.
