In 2006, the state of Virginia passed a law aiding in the establishment of the Virginia Birth Father Registry (VBFR). Formerly titled the Virginia Putative Father Registry, this database is maintained by the Virginia Department of Social Services to protect the paternal rights of unmarried fathers.

In some instances, a Front Royal man may father a child but does not have any sort of legal control over him or her due to either parent not establishing paternity. Putative fathers who register themselves in the database are provided with a notification if their child is being placed in foster care or for adoption. Likewise, the database can provide enhanced opportunities for fathers to gain co-parenting and visitation rights.

To effectively enter their details into the registry, a presumed father must submit their registration form via mail within 10 days of the child's birth. It's important to also remember that this action does not establish legal paternity and a voluntary agreement or legal paternity case will need to be filed in order to do so.

Establishing Paternity in Front Royal, VA

In Front Royal, VA, paternity establishment can be achieved in a few ways. Under Virginia law, if the mother and father are married for at least 10 months prior to a child's birth, the law presumes automatic paternity and no further actions will need to be taken.

In the case that a child is born out of wedlock, a Voluntary Acknowledgment of Paternity must be filed with the state to effectively establish paternity. This can be completed at the hospital following the child's birth or in the presence of a Warren County Juvenile and Domestic Relations representative.
