Background Screening Laws Specific to the City of Raleigh

Outside of federal background screening regulations, Raleigh employers are required to follow state-specific laws and regulations when using background checks during the application process. For example, the North Carolina Child Care Law establishes strict background screening requirements for those who plan to work in the child care industry.

Under this law, applicants who are inquiring into a position at a child care facility must undergo a criminal background check through various sources, including federal and North Carolina State fingerprint, sex offender, and child maltreatment registry databases. Furthermore, the state of North Carolina outlines specific background screening restrictions when it comes to state agency employers.

Under Executive Order 158, state employers are not allowed to inquire about criminal history during the application process. Once an applicant has been declared qualified for the position, then the employer may request that the applicant agrees to a criminal background check. Once a background check is complete, the employer is also prohibited from using any record of arrest that did not result in a conviction.

As a Raleigh employer, it’s important to understand that both job applicants and current employees are entitled to criminal history expungement under a recent North Carolina law. According to Raleigh Employment Attorney Thomas Manning, Senate Bill 445, passed in 2017, helps those with past convictions clear their criminal record. This law updated time restrictions from previous laws to allow individuals to request expungement by the state sooner rather than later.

For example, under Senate Bill 445, misdemeanor convictions may now be expunged after 5 years rather than the previously established 15. Felony convictions can now be expunged after 10 years instead of 15. A Raleigh resident must meet a variety of criteria to meet qualifications for expungement, including not being on parole or probation and having no ongoing warrants or pending criminal charges.
