Michigan Marijuana Laws

Overall Status: Fully Legal

Under Michigan marijuana laws, both adult-use recreational and medical marijuana are legal in the state of Michigan, as long as users follow Michigan marijuana compliance rules.

Medical Marijuana: Legal

Medicinal marijuana has been legal in Michigan since the Michigan Medical Marihuana Act, also called the Michigan Compassionate Care Initiative, was passed in 2008. This allows qualifying patients to gain legal access to medical cannabis by obtaining a registry ID card.

To qualify for medical marijuana use in Michigan, patients must be 18 or older. Patients can also designate a primary caregiver who is 21 years of age or older. The "debilitating medical conditions" currently listed under the medical marijuana act include:

Decriminalized: Yes

Since recreational marijuana is legal in Michigan, there are no criminal penalties for possession of 2.5 ounces or less. The first offense for possession of more than 2.5 ounces and up to 5 ounces is a civil infraction with a maximum fine of up to $500. Possession of more than 5 ounces is a misdemeanor with a maximum fine of $500. There is no jail time associated with marijuana possession in Michigan.

Recreational Marijuana: Legal

Recreational marijuana became legal in November of 2018 when voters in Michigan approved the Michigan Regulation and Taxation of Marihuana Act (MRTMA). This act allowed adults aged 21 and over to possess and consume cannabis in the state.

According to Michigan's recreational marijuana laws, adults over age 21 may possess a maximum of 2.5 ounces of marijuana, including no more than 15 grams of cannabis concentrate. In addition, adults may grow up to 12 marijuana plants in their homes and may possess up to 10 ounces of marijuana in their homes. Adults may also give away small amounts of cannabis but cannot legally sell it unless they have a license.
