The easiest and most reliable way to obtain a DNA sample for paternity testing is to swab the inner cheeks of the alleged father and child or children. These skin cells are known as buccal cells, and they rub off easily onto cotton swabs and remain in place for analysis by our laboratory.

Infant Considered Party to Paternity Suit

The complexities of paternity law were brought to light during a 2017 case involving a biological father’s appeal to stop the adoption of his infant son. The saga began when a mother gave birth to a child in Madison County and signed paperwork at the hospital to give the child up for adoption. The same day, the child’s father contacted the agency to object to the adoption. A week later he filed a paternity, custody, and child support petition in the Limestone Circuit Court.

When the prospective adoptive parents filed adoption paperwork, the father objected by submitted his paternity paperwork, which showed that there was a 99.99% chance that he was the father. Things got interesting when an attorney representing the infant filed a request to move the case to Tuscaloosa county, based on the fact that the child lived there with his prospective adoptive parents.

Despite the father’s objections, the case was moved. Although a child is not a named party in a court proceeding, he or she is a “permissible” party. The law has determined that a minor child does have a right to an attorney and can make legal objections in paternity cases. This complexity is one of the many reasons why it’s critical to hire a reputable and experienced child custody attorney any time paternity issues come up.
