Specimens we can test for DNA

The easiest and most reliable way to obtain a DNA sample for paternity testing is to swab the inner cheeks of the alleged father and child or children. These skin cells are known as buccal cells, and they rub off easily onto cotton swabs and remain in place for analysis by our laboratory.

Other specimen samples, such as hair follicles, fingernails, and garments that might contain someone’s DNA, can also be tested. An Alternative Specimen DNA Test is done by ordering one of our testing kits online and shipping the specimens back to us.

Legal DNA Tests vs. “Peace of Mind” At-Home Tests

A Legal Paternity Test is a court admissible lab testing service performed at an AABB accredited laboratory. Accurate results for DNA paternity testing with 99.99% confidence or greater take about a week.

When deciding which type of DNA test is right for you, consider first what you might do with the results. A legal paternity DNA test will hold up in court for such matters as child support or to change the name on a birth certificate. This test must be performed using strict chain of custody procedures. Our Newport Beach DNA testing technicians are trained to follow these guidelines so that the results will be legally admissible.

Newport Beach, California – DNA Testing

Paternity Programs in Newport Beach, CA

For unmarried Newport Beach couples who recently had a child, Orange County Child Support Services offers the Parentage Opportunity Program to help establish legal paternity. Paternity establishments are crucial as they create a legal bond between a biological father and child which allows both parents to create child support and custody agreements.

Through the Parentage Opportunity Program, both parents can complete a Voluntary Declaration of Parentage to establish paternity. This form should only be completed if DNA testing services have been used to identify the biological father or if there is zero doubt in the presumed paternity. Once properly filed, the father will gain parental rights over the child further allowing his name to be placed on the birth certificate.

Disputing Paternity in Newport Beach, CA

In certain instances, two parents who have already voluntarily established paternity will later learn that the presumed father is actually not the child’s biological father. The previously presumed father will continue to face legal child support obligations until the paternity establishment is disputed in court. Fortunately, following changes to California paternity law in the early 2000s, a Newport Beach parent now has the ability to dispute paternity establishments that have already been filed.

Highlighting the importance of DNA testing services in these situations, the California statute of limitations allows for an individual to file a motion to have a paternity declaration removed only up until two years after the child’s birth. Following the two-year mark, Orange County Courts require proof of paternity fraud, material mistake, or duress to have the disestablishment considered.

Experts in Newport Beach CA Say…

Outside of mistaken paternity, there are circumstances where a married Newport Beach mother has a child with a man who is not her husband. According to family law attorney Sharman Brooks, under California Family Code section 7540, there is always a conclusive presumption that a husband is the biological father of his wife’s child. This means that the husband could be held responsible for financially supporting a child that is not his unless DNA testing is used to remove these obligations through a court order.
