In North Carolina, parents have two options for establishing paternity if they are unwed. If they know the biological father's identity and there are no disagreements, they can sign the Voluntary Acknowledgment of Paternity (VAP). They can do so at the hospital after the child's birth, and the hospital staff can usually help them. However, the father must be present and provide all the necessary information and documents. Once both parents sign the VAP, they must file it with Vital Records, and their names will be added to the child's birth certificate.

Then things took a strange turn. The county attorney appealed the ruling and a higher court reinstated the child support. The justification was that, by statute, you have one year to deny paternity and too much time had passed. When asked for comment, both a judge and county attorney confirmed that the courts establish "paternity," not "biology." Once paternity has been established, it's very difficult to disestablish it. This is one of the many reasons to consult with an attorney before getting involved in any type of paternity issues.
