Specimens we can test for DNA

The easiest and most reliable way to obtain a DNA sample for paternity testing is to swab the inner cheeks of the alleged father and child or children. These skin cells are known as buccal cells, and they rub off easily onto cotton swabs and remain in place for analysis by our laboratory.

Other specimen samples, such as hair follicles, fingernails, and garments that might contain someone’s DNA, can also be tested. An Alternative Specimen DNA Test is done by ordering one of our testing kits online and shipping the specimens back to us.

A Legal Paternity Test is a court admissible lab testing service performed at an AABB accredited laboratory. Accurate results for DNA paternity testing with 99.99% confidence or greater take about a week.

Importance of Establishing Paternity in Puerto Rico

If a Fajardo child’s parents aren’t married when he or she is born, under Puerto Rico law, the child is considered to be without a legal father. According to attorneys at the Puerto Rico law firm of Zorrilla & Silvestrini, until paternity is established, a child’s mother in Fajardo has “sole parental responsibility” for the child. Not only does this mean the father will have no input into how the child is raised, but he also cannot request visitation or custody rights. In addition, the mother cannot receive child support without establishing legal paternity.

Social Security Case Highlights PR Paternity Laws

A 2013 case involving a child’s claim for Social Security survivor’s benefits brought to light real-life applications of Puerto Rico’s paternity laws. The case began when a child named “Erika” was born to an unmarried mother who did not put the father’s name on the child’s birth certificate. When the child’s alleged father died, her mother filed for Social Security survivor’s benefits for her children.

After Erika’s application was initially denied, the mother submitted additional evidence, including a DNA test. However, the test did not meet the necessary requirements. Despite this, the courts ordered that since the father had voluntarily acknowledged Erika as his daughter, she was considered his legitimate daughter. Therefore, she was entitled to these benefits just as much as any other legitimate child.

Puerto Rico’s Presumption of Paternity

Under Puerto Rico law, when children are born during a marriage, the mother’s husband is presumed to be the child’s legal father. This is also the case if a child is born within 300 days from when a marriage is terminated. If there’s reason to believe the man is not the child’s father, an interested party can challenge the presumption of paternity. The parties allowed to do so include the child’s mother, the presumed father, the child’s biological father, or the child (through a legal representative).
